LABOR LAW UPDATE
AUGUST 2006

REVISION FOR EMPLOYEE HANDBOOK

We recently reviewed the language of our Employee Handbooks and revised the Drug Testing Policy. Specifically, we have addressed the section on prescription drugs. We believe the revised section better complies with the Americans with Disabilities Act ("ADA"). We would encourage you to review your Employee Handbook and contact us to provide you with the following language concerning prescription drugs:

Prescription Drugs:  If job-related and consistent with business necessity, the Employer may require employees who use a prescription drug that may affect their ability to perform the essential functions of their position to report to their immediate supervisor when they are taking such medication.

If you have any questions or are in need of assistance regarding this notice, we would encourage you to call Attorney Hinda K. Kimmel or Mary H. Wyatt, Paralegal, to discuss how to simply incorporate this change into your Employee Handbook.  We look forward to addressing your questions or concerns.  As always, please feel free to contact the Labor, Employment, Municipal and Education Law Department of Suisman, Shapiro, Wool, Brennan, Gray & Greenberg P.C. at 442 4416 with any questions you may have.
